General Terms and Conditions of Use

Purpose and scope:

These Terms of Use regulate access to the Wi-Fi service provided by Aena S.M.E., S.A. (hereinafter, Aena), which, as the owner of the service, offers to USERS (people who use the SERVICE).

The purpose of the General Terms and Conditions of Use is to regulate access, browsing and use of the SERVICE. Despite this, Aena may establish particular conditions to regulate the use or contracting of specific services. In the event of any discrepancy between the General Terms and Conditions of Use and the specific conditions of a specific service, the latter shall prevail.

Access to and navigation through the SERVICE implies knowledge and unconditional acceptance by the USER of all the legal information and conditions of use detailed in these General Conditions of Use.

Conditions for the provision of the SERVICE

The conditions for the provision of the basic access service to the Internet subscribed between Aena and the USER are the following:

  1. 1. Aena will provide the USER with the SERVICE referred to in these Conditions. This SERVICE consists of wireless access (WIFI) to the Internet.
    To access the SERVICE, the USER must have a DEVICE (understood as any electronic device, for example, laptop, tablet, mobile). Said DEVICE must have WIFI technology.

  2. 2. The USER will not be able to contract a new SERVICE from the same DEVICE within 24 hours of the previous contract.

  3. 3. Access to the SERVICE is carried out through a user code or password. The USER is responsible for saving these codes In case of their loss, the USER can restart the SERVICE through the User Service Centre (CAU), by providing their email and flight number.

  4. 4. The SERVICE is free for USERS, but some services on the Aena website may have a cost, as determined in the Specific Conditions.

  5. 5. The establishment of links does not imply in any case the existence of any relationship between Aena and the owner of the corresponding website. Any unions, links, forwardings or associations with other web pages, made possible from the access, registration and service contracting pages (hereinafter, the PAGES) do not carry a guarantee from Aena to the USER.

  6. 6. In the Privacy Policy, the USER can obtain the necessary information in relation to the processing of their personal data.
    Failure to accept these access conditions or failure to respond to any of the fields requested as mandatory will make it impossible to access the free Internet services provided by Aena. The act of filling out the forms implies that you acknowledge that the information and personal data you provide us with are yours, accurate and true.

  7. 7. In the Cookies Policy the USER can obtain the necessary information in relation to the “cookies” used on this Website.

    The texts, designs, images, databases, logos, structure and other elements of this SERVICE are protected by current legal regulations on intellectual and industrial property. Any reproduction, transmission, adaptation, translation, modification, communication to the public, or any other exploitation of all or part of the content of this site, carried out in any form or by any means, electronic, mechanical or other, is strictly prohibited without prior authorisation in writing from Aena.

  9. 9. Aena reserves the right to:

    - Modify these Terms and Conditions applicable to this SERVICE.

    - Modify the terms and conditions of future accesses without direct login, these being accepted for all re-connections without login.

    -Introduce advertising on the registration pages.

    - Modify automatic reconnection times without prior notice.

  10. 10. The parties, expressly waiving their own jurisdiction if they have any, submit for the resolution of any controversy arising from the interpretation and/or execution of this contract, to the Jurisdiction of the Courts and Tribunals of the city of Madrid, because this is the place of fulfilment of the obligation. In any case, Spanish law will apply.

  11. 11. Aena reserves the right to limit both the bandwidth and the URLs consulted without prior authorisation from the USER, as well as to interrupt the service at any time if it considers it necessary.

  12. 12. The WIFI service will be for exclusive use by individuals. Use by companies or any type of entity is not authorised. If business use is detected, Aena may interrupt or limit the service without prior notice.

  13. 13. Once the USER exhausts their connection quota, either by exceeding the session quota or exceeding the data quota, they will experience a decrease in browsing or data download/upload speed. The quota limits depend on the type of SERVICE purchased through the registration method.
    The GENERAL SERVICE, obtained by registering in any area of the airport premises except the VIP lounges, offers an unlimited transparent authentication period, a session quota of 4 hours every 24 hours and a data quota of 6 GB every 24 hours.
    In comparison, the VIP SERVICE, obtained by registering in VIP lounges, features an unlimited authentication period, a 24-hour session quota per 24 hours, and a data quota of 6 GB per 24 hours. It is established that the access speed is 20 Mbps for the general service, 60 Mbps in VIP rooms and 40 Mbps in Aena Club. It is important to note that Aena does not assume responsibility for possible damages or losses caused by service interruptions, and the unlimited period of transparent authentication is invalidated if the user does not connect within one year, which will result in the deletion of their registration data and it will be necessary to make a new registration.

  14. 14. Aena, being responsible for the file and processing, will adopt the necessary measures to guarantee an adequate level of security, including the confidentiality of the personal data provided by the USER, taking into account the state of the art regarding risks and the nature of the personal data that must be protected.

    • Aena is not responsible for any damage or harm caused by interruptions or failures of the SERVICE.
    • Aena is not responsible for the consequences of force majeure or unforeseen circumstances.
    • Aena is not responsible for failures of communication lines or the internet network.
  3. 3. Damage to equipment or information:

    • Aena is not responsible for any damage or harm caused to your device or software due to the use of the service.
    • Aena is not responsible for the loss of or damage to information stored on your device.
    • Aena is not responsible for the introduction of computer viruses on your device.
  4. 4. Improper use of bank details:

    • Aena is not responsible for the improper use of your bank details by other users.
  5. 5. With regard to the Advertisements, opinions, offers, proposals, products, goods, services, data or other information displayed or distributed through the access, registration and service contracting pages:

    • Aena is not responsible for their veracity, reliability, integrity or legality.
    • Aena is not responsible for USER transactions carried out with third-party advertising.
    • Aena is not responsible, directly or indirectly, for any damages caused by the USER's access to the links on the PAGES.
  6. 6. Aena will not be responsible in the event of the USER providing false information and personal data.

    • 7. Aena is not responsible for the browsing use of a minor (under 18 years of age) on their device, nor for any damages caused to third parties, including the minor themselves, due to non-compliance with current legislation or the General Conditions of Use of the service. We recommend that parental control mechanism options be enabled on devices that are provided to children under 18 years of age.

      Obligations and rights of USERS

      1. 1. The USER undertakes to:

        • Use the service in a responsible and legal manner, refraining from carrying out any act that may cause harm to Aena, third parties or other users.
        • Not use the service to carry out illegal activities or activities that may damage the Aena system or infrastructure.
        • Provide personal data relating to yourself. In the event of any modification to their data, Aena asks USERS to notify them in order to keep it updated. Aena will not be responsible in the event of the USER providing false information and personal data.
      2. 2. The USER will be responsible for:

        • The veracity and accuracy of your personal data. In the event that Aena detects the introduction of false data, Aena reserves the right to prohibit access or cut off access that has already been iniciated.
        • Any damage caused to Aena or third parties due to the use of the service.
        • Any damage caused to Aena or the establishment where you use the service due to negligence or fault.
        • The use you make based on the WIFI service, as well as the acts you commit.
        • To make lawful use of the service in accordance with current legislation.
      3. 3. The USER declares to be over 18 years of age.

        • 4. The USER accepts at his or her risk the economic transactions carried out via the WIFI service, this service nor the parts that make it up being PCI- Dss certified or equivalent.
